Terms of Use
Last updated: 12 August 2026
These terms are the agreement between you and Torvus for use of the Torvus mobile app and website. By creating an account or using Torvus, you accept them. If you do not accept them, please do not use Torvus.
1. Who we are
Torvus ("we", "us") is a fitness coaching platform registered in Croatia. You can contact us at [email protected].
2. Eligibility and your account
You must be at least 16 years old to create a Torvus account on your own. You sign in using a Google or Apple account, and you are responsible for keeping access to that account secure. You are responsible for activity that happens under your account.
You agree to give accurate information and to keep it up to date. You may not share your account with someone else, or create an account on behalf of another person without their permission.
3. Spaces, trainers and clients
Torvus is organised into spaces — a gym or coaching practice run by a trainer, with clients and staff invited into it.
- A space owner is responsible for who they invite, for how they use their clients' information, and for the coaching they provide. Where a space owner collects personal data from their clients through Torvus, they are responsible for having a lawful basis to do so.
- Clients should understand that joining a space makes their training data visible to the trainer and staff of that space, as described in our Privacy Policy.
- We are not a party to the coaching relationship between a trainer and their clients, and we are not responsible for the quality, safety or suitability of the programming a trainer provides.
4. Health and safety
Torvus is a tool for recording and organising training. It is not medical advice. We do not provide medical, physiotherapeutic or nutritional advice, and nothing in the app should be treated as such.
Physical training carries a risk of injury. Consult a qualified physician before beginning any new training programme, particularly if you have an existing medical condition, are pregnant, or are returning from injury. Stop and seek medical help if you experience pain, dizziness or discomfort.
You train at your own risk, and you are responsible for judging whether any given session or load is appropriate for you.
5. Subscriptions and payment
Some Torvus features require a paid subscription. Subscriptions are sold and processed by the Apple App Store or Google Play, not by us directly.
- The price, billing period and what is included are shown on the purchase screen in the app before you confirm.
- Subscriptions renew automatically at the end of each billing period, at the then-current price, unless you cancel at least 24 hours before the period ends.
- You manage and cancel your subscription through your Apple or Google account settings — not through us. Deleting the app does not cancel a subscription.
- Payment is taken by the app store on confirmation of purchase, and again on each renewal.
- Refunds are handled by the app store under its own policy. We cannot issue refunds for store purchases directly, though we will help where we can.
- We may change subscription prices. Changes apply from your next billing period, and we will give you notice before they take effect so you can cancel if you prefer.
6. Acceptable use
You agree not to:
- use Torvus unlawfully, or to harass, abuse or harm anyone;
- upload content you do not have the right to upload;
- upload anything unlawful, offensive, or that infringes someone else's rights;
- attempt to access accounts, spaces or data that are not yours;
- probe, scan, overload or interfere with our systems, or circumvent any access restriction;
- reverse engineer, decompile or attempt to extract our source code, except where the law expressly permits it;
- scrape or bulk-extract data from Torvus, or resell access to it without our agreement.
7. Your content
You keep ownership of everything you put into Torvus — your workouts, templates, photos and records. You grant us a limited licence to store, process and display that content strictly as needed to operate the service for you and the space you belong to. We do not use your content for any other purpose, and we do not claim any ownership of it.
You are responsible for the content you upload and for having the right to upload it — including any photograph that shows another person.
8. Availability and changes
We aim to keep Torvus available and working, but we do not guarantee uninterrupted service. We may change, suspend or discontinue features, and we may run maintenance that makes the app temporarily unavailable. Where a change materially reduces what a paid subscription provides, we will tell you in advance.
9. Ending the agreement
You may stop using Torvus and ask us to delete your account at any time, by emailing [email protected]. Cancelling a subscription is done through your app store, as described above.
We may suspend or terminate your access if you materially breach these terms, if your use puts other users or our systems at risk, or if we are required to by law. Where it is reasonable to do so, we will warn you first and give you an opportunity to put things right.
10. Disclaimers
Torvus is provided "as is" and "as available". To the fullest extent permitted by law, we exclude implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the app will be error-free, or that data you enter will never be lost — please keep your own records of anything you cannot afford to lose.
11. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, loss of profit, loss of data, or personal injury arising from training you choose to undertake.
Where our liability cannot be excluded, it is limited to the greater of the amount you paid us in the 12 months before the claim, or EUR 50.
Nothing in these terms excludes liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded. If you are a consumer, you keep all mandatory rights that consumer law gives you, and nothing here overrides them.
12. App store terms
Where you obtained Torvus from the Apple App Store, the following applies:
- This agreement is between you and Torvus only, not with Apple. Apple is not responsible for the app or its content.
- Your licence to use the app is a non-transferable licence to use it on Apple-branded devices you own or control, as permitted by the App Store Terms of Service.
- Apple has no obligation to provide maintenance or support for the app. Support requests should go to [email protected].
- If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price if applicable; beyond that, Apple has no other warranty obligation.
- Apple is not responsible for addressing any claim by you or a third party relating to the app, including product liability, legal or regulatory non-compliance, or consumer protection claims.
- Apple is not responsible for investigating, defending or resolving any third-party claim that the app infringes intellectual property rights.
- You confirm you are not located in a country subject to a U.S. Government embargo or designated as a terrorist-supporting country, and that you are not on any U.S. Government prohibited-parties list.
- Apple and its subsidiaries are third-party beneficiaries of these terms and have the right to enforce them against you.
Where you obtained Torvus from Google Play, Google Play's own terms apply to your download and to any purchase you make there, in addition to these terms.
13. Third-party software
Torvus includes open-source components, listed with their licences on our Open-source licenses page. Those components are governed by their own licences.
14. Changes to these terms
We may update these terms. We will change the date at the top of this page, and where a change materially affects your rights we will notify you in the app before it takes effect. Continuing to use Torvus after a change means you accept the updated terms.
15. Governing law
These terms are governed by the laws of the Republic of Croatia, and the courts of Croatia have jurisdiction. If you are a consumer resident elsewhere in the EU, you keep the protection of the mandatory laws of your country of residence and may bring proceedings there.
